If you are commissioning services on behalf of another person or organization, you represent that you have the authority to bind that party to these Terms.
If you do not agree to these Terms, please do not use the website or commission services from Bespoke Vows.
2. Services
Bespoke Vows provides professional writing and consultation services, including but not limited to:

Services may be delivered remotely or in person depending on the arrangement agreed upon at the time of booking. The specific scope of services for each engagement will be confirmed in a separate client agreement or written communication.
3. Nature of the Service
Bespoke Vows provides writing and consultation services only, unless otherwise explicitly agreed to in writing. Unless separately contracted, Bespoke Vows is not responsible for:

Officiating or legally solemnizing the ceremony

Event planning or venue coordination

Logistical or day-of coordination

Marriage licensing or compliance with local marriage laws
Responsibility for legal compliance with applicable marriage laws rests with the couple and their officiant.
4. Use of the Website
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

Use automated tools, bots, or scrapers to access or collect content from this website

Attempt to gain unauthorized access to any part of the website or its infrastructure

Submit false or misleading information through any contact form or communication channel

5. Client Responsibilities
Clients agree to:

Provide accurate, complete, and timely information necessary for the completion of commissioned work

Ensure that any personal stories, family histories, cultural details, or other content shared for use in the ceremony may lawfully be included and spoken aloud at a public event

Review the final script thoroughly before the ceremony and raise any concerns in writing prior to the ceremony date

Obtain any necessary permissions from third parties whose personal information or stories may be referenced in the ceremony
Bespoke Vows relies on the accuracy of information provided by clients and does not independently verify personal details, historical claims, or the accuracy of stories shared during consultation.
6. Payment
Fees, payment schedules, and deposit requirements will be agreed upon in writing prior to the commencement of services. Work will not begin until the agreed deposit or full payment has been received.
All fees are quoted and payable in US dollars unless otherwise agreed. Applicable taxes are the responsibility of the client where required by law.
Payment terms, refund policies, and any late payment consequences will be specified in your client agreement. Bespoke Vows reserves the right to suspend or cease work if payment obligations are not met.
7. Intellectual Property
Ownership Prior to Full Payment
All scripts, outlines, and written materials produced by Bespoke Vows remain the intellectual property of Bespoke Vows until full payment has been received. Delivery of materials does not constitute transfer of ownership unless payment has been completed.
License Upon Full Payment
Upon receipt of full payment, the client receives a non-exclusive, non-transferable, royalty-free license to use the written work for their ceremony and personal, non-commercial purposes. This license does not include the right to resell, sublicense, or publish the work commercially.
Portfolio and Promotional Use
Bespoke Vows retains the right to reference or adapt anonymized portions of commissioned work for portfolio or promotional purposes. If you wish to keep your ceremony content confidential, you must request this in writing prior to the commencement of services. A confidentiality request will be honored and confirmed in your client agreement.
Website Content
All content on www.bespokevows.com — including text, design elements, and other materials — is owned by or licensed to Bespoke Vows and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use website content without our prior written consent.
8. Revisions
The number of included revisions will be specified in your client agreement. Revisions must be requested within the timeframe specified at the time of engagement.
Reasonable revisions to existing content are included as agreed. The following may be subject to additional fees:

Major changes to the narrative direction, tone, or structure of the ceremony

Additions of significant new content not discussed during the original consultation

Revisions requested after the agreed revision period has closed
All revision requests should be submitted in writing. We will confirm in writing whether any additional charges apply before proceeding.
9. Advertising and Data Collection
Bespoke Vows uses advertising measurement technologies — including pixels, cookies, and hashed identifier matching — to measure the effectiveness of our marketing campaigns and to reach prospective clients through platforms such as Meta (Facebook/Instagram) and Google.
By using this website, you acknowledge that these technologies may be active on the site. You may manage your preferences through the cookie consent controls available on this website, or opt out as described in our Privacy Policy.
Our collection and use of personal information, including for advertising purposes, is governed by our Privacy Policy, which is incorporated into these Terms by reference and is available at www.bespokevows.com/privacy-policy.
10. Disclaimer of Warranties

11. Limitation of Liability

Errors or omissions introduced after delivery of the final script

In no event shall Bespoke Vows’s total liability to you for any claim arising out of or related to these Terms or the services exceed the total fees paid by you for the specific engagement giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
12. Indemnification
You agree to indemnify, defend, and hold harmless Bespoke Vows and its affiliates, contractors, and representatives from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:

13. Content Standards and Right to Decline
Bespoke Vows reserves the right to decline, revise, or remove any content that is:

Unlawful or in violation of any applicable regulation

Sexually explicit, threatening, or otherwise inconsistent with professional standards

Factually false in a way that could expose any party to legal liability
If a content concern arises during an active engagement, we will notify you in writing and work with you to find an appropriate resolution. In cases of serious concern, we reserve the right to terminate the engagement subject to the payment terms in your client agreement.
14. Termination
Either party may terminate a service engagement prior to completion, subject to the payment terms agreed upon at the time of booking. Specifically:

If the client cancels after work has commenced, payment may be required for work completed up to the date of cancellation, as specified in the client agreement.

If Bespoke Vows terminates the engagement for reasons unrelated to client breach, we will refund any portion of prepaid fees attributable to work not yet completed.

If Bespoke Vows terminates due to client breach of these Terms or the client agreement, fees already paid may be forfeited in accordance with the terms agreed at booking.
Termination of an engagement does not affect any rights or obligations that accrued prior to termination, including payment obligations and intellectual property rights.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
Any dispute arising out of or related to these Terms or the services that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in New York, and you consent to personal jurisdiction in those courts.
Before initiating any formal proceedings, both parties agree to attempt to resolve any dispute in good faith through direct communication. Either party may initiate this process by sending written notice of the dispute to the other party.
16. Consumer Rights — EEA and UK Users
If you are located in the European Economic Area or United Kingdom, you may have statutory consumer rights that these Terms cannot limit or exclude. Nothing in these Terms is intended to affect any rights you have under applicable consumer protection law, including:

The right to services that are performed with reasonable care and skill

Rights under the EU Consumer Rights Directive or UK Consumer Rights Act 2015, as applicable

The right to seek redress through alternative dispute resolution (ADR) mechanisms available in your jurisdiction
Where any provision of these Terms conflicts with your statutory consumer rights, your statutory rights will prevail to the extent of the conflict.

Bespoke Vows reserves the right to update these Terms at any time. Updated Terms will be posted on this page with a revised effective date. For active engagements, any material changes will be communicated to you directly.
Your continued use of the website or services after updated Terms have been posted constitutes your acceptance of the revised Terms.
18. General Provisions
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy and any applicable client agreement, constitute the entire agreement between you and Bespoke Vows with respect to your use of the website and services, and supersede all prior or contemporaneous communications and proposals.
No Waiver
Failure by Bespoke Vows to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.
